DOT commercial rig loophole?

    I thought I read somewhere there was a loophole for getting aroung the commercial truck laws. Somebody mentioned horse racing as a hobby and I thought there was some catch that even though we race for prize money, being a hobby it is not a commercial enterprise.

    Was I just sniffin' too much nitro????

    The states are coming down on rigs. No loophole big enough to drive through. Some states are even popping duallies. You might drive at night with the lights out and get away with it, though.

    In the COMMY state of MASS anything with 5 wheels on the ground has to be registered commercial. ( to be legal) .

    What happened to being able to register the rig as a motor(toter)home as long as it has a toilet, bed and frig.?

    Oh and as far as variances from state to state.. I thought everything went to national standards when the whole CDL thing happened.

    National Standard

    The catch 22 is; the national standard was set up for commercial vehicles only, not private ones. You can’t have it both ways, operating as a private vehicle, using commercial standards. I have been in the transportation industry for over 25 years and can tell you when it comes to any kind of tractor/trailer (power unit with trailer) federal laws apply on interstate highways. The minute you operate/drive onto a State, county or local road the laws of that State are applicable, and each state has it’s own laws pertaining to a particular truck and trailers combination.

    Check the internet for your state, IE California DOT, Oregon DOT, etc.

    Most states are adopting Federal DOT guidelines if they haven't already done it. I won't mention any names, but someone we all know got a $2,500 ticket in Albuquerque. Another got a $600 ticket in Kansas. They we both asked to "Please" return to the scales.

    Go to a truck stop or office supply store and buy a trucker’s atlas. Generally these have a listing in the front for each states regulatory bodies you can contact for information about how to get legal. The federal DOT in Washington is also a good source for this type of information. Also there are companies such as J J Keller in Wisconson that specialize in permitting commercial and/or privately operated vehicle.

    Now if I could just find a tailgate lift door for the double drop trailer I just bought....... .

    loop hole

    fmcsa.gov is a good site for rules and reg for trucks
    i have been in trucking for 25 years
    at home the troopers are even stopping 2 horse trailer to check weight
    and to see if it needs a dot number .my dad got a ticket for not having this number . he had recived some prize moneyand this made he need a dot number

    I think this is the question on the fed site that will put us all in the commercal truck deal regardless what we think. I think almost all the rigs weigh in at more than 10,000 lbs truck and trailer combined :eek:

    Do you operate a motor vehicle with a gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR)or gross vehicle weight (GVW) or gross combination weight (GCW)of 4,536 kilograms (10,001 lbs) or more in interstate commerce?

    Wasn't the question "interstate commerce?" Depends on who's definition of interstate commerce. The one issueing the ticket!

    feds veiw on interstate is:

    Interstate commerce is trade, traffic or transportation across a State line, including international boundaries, or wholly within one State as part of a through movement that originates or terminates in another State or country.

    Not sure i like their definition...
